Each service package may be subject to specific terms outlined in individual service agreements.

4. Account Creation and Access

Users may create accounts to access certain features. You agree to:

• Provide accurate, current, and complete information
• Maintain security of your login credentials
• Not share your account with others
• Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts for violations of these Terms.

4. Subscription and Payments

We offer monthly subscription plans with varying service levels. By subscribing, you:

• Authorize us to charge your payment method on a recurring basis
• Agree to the pricing, features, and billing frequency provided at the time of subscription
• May cancel in writing at least 72 hours prior to your next billing date to avoid charges

Failure to pay may result in suspension of services. All fees are non-refundable except as required by law or otherwise stated in our refund policy.

5. Payment Terms

5.1 Setup Fee
A one-time setup fee is due upon hiring. Clients may choose to split this into two payments: 60% at the time of hiring, and 40% on the onboarding day.

The setup fee includes:

• Strategy consultation and project planning
• Funnel design and layout
• Initial copywriting for key funnel pages
• Technical integration and system configuration
• Platform setup (e.g., CRM, automation tools, calendars)
• Branding elements and visual design (where applicable) – this refers to incorporating the client’s existing branding into the platform, ensuring elements such as estimates, invoices, and receipts are properly customized to reflect their brand. Please note, this does not include creating or designing brand assets from scratch; brand development is a separate service available for an additional fee.

5.2 Subscription Billing
We offer monthly subscription plans with varying service levels. By subscribing, you:

• Authorize us to charge your payment method on a recurring basis
• Agree to the pricing, features, and billing frequency provided at the time of subscription
• May cancel at least 72 hours prior to your next billing date to avoid charges

Failure to pay may result in suspension of services. All fees are non-refundable except as required by law or otherwise stated in our refund policy.

6. Client Responsibilities

Clients must provide timely feedback, approvals, and access to assets necessary for the completion of services. Delays caused by client inaction may impact timelines and delivery schedules.

7. Refund & Cancellation Policy

7.1 Cancellation Within Three (3) Business Days
Clients may cancel their service within three (3) business days of the first payment to receive a refund. Notice of cancellation must be submitted via email to ensure accurate timestamping. A non-refundable processing fee of $397 will be deducted from the refund to cover the value of the initial strategy consultation and project planning services rendered.

7.2 Cancellations After Project Initiation
If cancellation occurs after the project has started, the client is responsible for 50% of the setup fee. Ongoing monthly payments may be stopped with at least 72 hours’ notice before the next billing date.

8. User-Generated Content

By uploading or creating content (text, images, video, designs, etc.) on our platform, you retain ownership of your content but grant Lux Funnels LLC a non-exclusive, worldwide, royalty-free, sublicensable license to:

• Use, host, reproduce, adapt, publish, display, and distribute your content solely for service delivery and promotional purposes

You represent that you own or have the necessary rights to use and authorize the use of your content. You agree not to upload or create content that:

• Violates any law or regulation
• Infringes the intellectual property of others
• Contains malware or harmful code
• Is obscene, defamatory, or harmful to others

We may remove content or suspend accounts that violate this section.

9. Use of Artificial Intelligence (AI) Assisted Services

Lux Funnels LLC utilizes Artificial Intelligence (AI) tools to assist in delivering certain aspects of our services. AI is used in areas such as content ideation, refinement, funnel building, automation setup, chatbot responses, and appointment booking—specifically for clients subscribed to plans that include AI features.

We use AI tools under human supervision and strategic direction. All inputs are based on real information provided by the client, and all AI-generated outputs are reviewed, edited, and approved by a member of our team to ensure accuracy, alignment, and quality.

By default, AI use contributes to less than 50% of any client deliverable. Clients may request details about AI involvement, and we will disclose accordingly. Unless explicitly requested, we do not label deliverables as AI-generated.

10. Termination

We may suspend or terminate your access without notice if you breach these Terms. You may cancel your subscription anytime through your dashboard or by contacting support. Upon termination, your access to the Service and associated content may be removed.

11. Intellectual Property

All content, features, and functionality (excluding User-Generated Content) including but not limited to text, graphics, logos, and software, are owned by Lux Funnels LLC and are protected by copyright and trademark laws. You may not reproduce or use such materials without our written consent.

12. Links to Third-Party Sites

Our site may include links to third-party websites or services. We do not endorse or assume responsibility for content, privacy policies, or practices of these third parties. Accessing any such sites is at your own risk.

13. Limitation of Liability

To the fullest extent permitted by law, Lux Funnels LLC and its affiliates shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising from your use of the Service. Our total liability shall not exceed the greater of $100 or the amount paid by you in the twelve (12) months preceding the claim.

14. “AS IS” and “AS AVAILABLE” Disclaimer

The Service and all materials, information, software, products, and services included in or available through the Service are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied.

To the fullest extent permissible under applicable law, Lux Funnels LLC disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• the Service will be uninterrupted, timely, secure, or error-free,
• the results that may be obtained from the use of the Service will be accurate or reliable,
• any errors in the Service will be corrected,
• or that the Service is free from viruses or other harmful components.

You expressly agree that your use of the Service is at your sole risk. Any material downloaded or otherwise obtained through the use of the Service is done at your own discretion and risk, and you are solely responsible for any damage to your computer system or loss of data that results from the download of any such material.

No advice or information, whether oral or written, obtained by you from Lux Funnels LLC or through or from the Service shall create any warranty not expressly stated in these Terms.

15. Service Hours & Support

Lux Funnels operates Monday through Friday, 9:00 AM to 5:00 PM Eastern Time. Support is available via email at support@luxfunnels.com  and scheduled calls during business hours. Service-level expectations will be outlined in the service agreement. Support is provided asynchronously and responses will be issued during standard business hours.

Scope of Support:

• General customer service inquiries (billing, login issues, etc.)
• Access troubleshooting for platform usage
• Order fulfillment and service/product delivery assistance

16. Confidentiality

All information shared between Lux Funnels and the client is treated as confidential. We agree not to disclose or use any proprietary or sensitive information for purposes outside the scope of the agreed-upon services.

17. Copyright and DMCA Policy

If you believe your copyright has been violated, please send a detailed takedown notice to support@luxfunnels.com. Include your name, contact information, identification of the copyrighted work, and a statement of good faith.

18. Limitation of Liability

To the fullest extent permitted by law, Lux Funnels LLC and its affiliates shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising from your use of the Service. Our total liability shall not exceed the greater of $100 or the amount paid by you in the twelve (12) months preceding the claim. 

19. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Pinellas County, Florida.

10. Termination
